Legal Provision

• As per Rule 10G , only those persons who have undertaken or propose to undertake international transactions are eligible to enter into an APA. Such eligible persons must file Form No. 3CED as the application for the agreement.
• For continuing transactions already being undertaken, the application in Form No. 3CED must be filed any time before the first day of the previous year relevant to the first assessment year for which the APA is proposed.
• For new transactions, the application must be filed before undertaking the transaction.
• The application must be accompanied by proof of payment of prescribed fees, which are as follows:

Applicable For:

Any person who—

1. has undertaken an international transaction; or
2. is contemplating undertaking an international transaction,

shall be eligible to enter into an agreement under these rules.
