Section 8 of the Right to Information Act, 2005 read with section 138 of the Income-tax Act, 1961 - Exemption from disclosure of information - Personal information - Merely because proviso to clause (j) of section 8(1) carves out an exemption that personal 'information which cannot be denied to Parliament or State Legislature shall not be denied to any person', disclosure of Income Tax Returns of a public representative cannot be made unless a larger public interest is shown to be served - Where disclosure of Income Tax Returns of a public representative was sought to 'compare his affidavit given to Election Commission with his Income Tax Returns', it could not be said that such disclosure would serve any larger public interest and, hence, impugned order passed by Central Information Commissioner confirming orders passed by First Appellate Authority and CPIO denying disclosure so sought, would not suffer from any illegality or infirmity - Held, yes [Paras 10 and 25]
